AND NOW . . . THE SURVIVING MEMBERS OF SUBLIME *CAN'T* CALL THEMSELVES SUBLIME:

The family of dead SUBLIME singer BRADLEY NOWELL has succeeding in stopping the surviving band members from performing under that name.

Recently, drummer BUD GAUGH and bassist ERIC WILSON picked up a new singer named ROME RAMIREZ to replace Nowell, who died of a heroin overdose in May of 1996.  They already played one gig as Sublime less than two weeks ago.

(The estate tried get a court order to stop them then, but they were denied.)

Nowell's estate has been going after the surviving members on a trademark claim.  They say Nowell was the sole owner of "Sublime" . . . and never intended for the name to be used in a band he was not a part of.

And yesterday, a judge sided with them, and issued an injunction against the use of "Sublime."  (That means that the judge thinks the estate will ultimately prevail, and so he's barring the band from using the name in the meantime.)

In a statement, Nowell's family said, "We are gratified the Court ruled in our favor.  We believe this will help protect and preserve Brad's musical legacy."

Bud and Eric issued the following statement, "Our goal continues to be sharing the music and message of Sublime with all of our fans around the world.

"We intend to take the court's advice and work on a business solution to this issue.  We hope the estate follows suit so the music of Sublime can live on and be accessible to everyone."
